These Terms & Conditions ("Terms") govern your use of the website floridaartifactadventures.com (the "Site") and participation in any tours, experiences, or services ("Services") offered by Florida Artifact Adventures ("we," "us," "our," or the "Company"), a [Florida LLC / business entity]. By accessing the Site, making a booking, or participating in a tour, you ("you," "participant," or "user") agree to be bound by these Terms. If you do not agree, do not use the Site or book Services.

1. Booking and Payment
Bookings are made through the Site or by contacting us directly. A booking is confirmed upon receipt of payment (full or deposit as specified). All prices are in USD and subject to change. Payments are processed via secure third-party providers (e.g., Stripe or PayPal); we do not store full payment details. You are responsible for providing accurate information during booking.

2. Eligibility and Participant Requirements
You must be at least 18 years old to book. Minors under 18 require a parent/guardian signature on waivers and must be accompanied. Participants must be in good health and able to perform light physical activities (walking, hand-digging, pushing soil through sifting tables). We reserve the right to refuse participation if, in our reasonable opinion, a participant poses a safety risk.

3. Cancellations and Refunds

  • Cancellations by you: [e.g., Full refund if 14+ days before tour; 50% refund 7-13 days; no refund within 7 days.]

  • Weather or other uncontrollable events: Tours may be rescheduled or refunded at our discretion if unsafe (e.g., heavy rain, flooding). No refunds for no-shows or late arrivals.
    We may cancel for any reason (e.g., insufficient bookings, safety concerns) and will offer a full refund or reschedule.

4. Assumption of Risk, Liability Waiver, and Release
Participating in artifact hunting tours involves inherent risks, including but not limited to uneven terrain, insect bites, sun exposure, minor cuts/scratches from digging/sifting, wildlife encounters, weather changes, and potential for slips/falls. By participating, you voluntarily assume all such risks. You hereby release, waive, discharge, and covenant not to sue Florida Artifact Adventures, its owners, guides, employees, agents, affiliates, landowners, or successors (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising from injury, illness, death, property damage, or loss related to your participation, even if caused by negligence of the Released Parties (to the fullest extent permitted by law). You agree to indemnify and hold harmless the Released Parties from any claims brought by third parties arising from your actions.

5. Artifacts and Ownership
All artifacts discovered remain the property of the private landowner unless otherwise agreed. Participants may keep personal, non-significant finds (e.g., common arrowheads, pottery shards) for personal use only, subject to applicable laws. No commercial sale or export of artifacts is permitted without proper permits. We comply with Florida law; no archaeological artifacts may be collected from state/public lands without permits. Tours are conducted only on permitted private property.

6. Conduct and Rules

  • Follow guide instructions at all times for safety and site preservation.

  • No digging outside designated areas; no metal detectors unless approved.

  • Respect the land: Leave no trace, no littering, no removal of plants/structures.

  • Alcohol/drugs prohibited. Disruptive behavior may result in removal without refund.

  • Photography is allowed; we may use participant photos/videos for marketing (you grant us a royalty-free license).

7. Health and Safety
You confirm you have no medical conditions that could be aggravated by the activity. Bring water, sunscreen, insect repellent, closed-toe shoes, and appropriate clothing. We provide basic first aid; serious issues may require calling emergency services (at your expense).

8. Intellectual Property
The Site content (text, images, logos) is our property. You may not copy or use without permission.

9. Changes to Terms
We may update these Terms. Continued use constitutes acceptance. Check this page periodically.

10. Governing Law and Disputes
These Terms are governed by Florida law. Any disputes shall be resolved in courts of [your county, e.g., appropriate Florida county], with venue there.
